New Bail Bondsmen Law in Tennessee

A new statute in Tennessee requires all bail bondsmen to obtain state licensure, with oversight provided by the Tennessee Department of Commerce and Insurance (TDCI). The legislation became effective on Thursday, January 1.

Pursuant to this regulation, bail bondsmen must register with the TDCI’s Division of Regulatory Boards and secure a license from the Board of Professional Bondsmen. Local courts retain the authority to determine which bondsmen may operate within their jurisdictions, contingent upon completion of state licensing requirements.

State officials indicate that these measures are intended to enhance consumer protection and establish uniform professional standards statewide.

Applicants must submit background checks from both the Tennessee Bureau of Investigation and the FBI, dated within the past twelve months, as well as documentation demonstrating judicial district approval.

Provided all conditions are satisfied, the state seeks to process applications within seven business days.

Furthermore, the law empowers the state to investigate complaints and administer disciplinary actions against bail bondsmen, including suspension or revocation of licenses and the imposition of civil penalties.
